LH Chandrasekara Group: Terms of Service

These Terms of Service ("Terms") govern your use of the L H Chandrasekara & Brothers (Pvt) Ltd ("LHC Group," "we," "us") Hybrid Online Ordering Platform (the "Platform"). By accessing or using the Platform, you agree to comply with and be bound by these Terms.

1. Online Ordering System (Quotation Builder)

• Order Placement: Placing products in the Order List (Cart) and submitting the Checkout form constitutes an Order Request (or Quotation Request), not a finalized purchase contract.
• Confirmation: All Order Requests, including stock availability, final pricing, shipping fees, and chosen payment method, are subject to final human confirmation by an LHC Group Sales Representative via phone or email.
• B2B Orders: Orders placed via the B2B Partner Portal are additionally subject to verification against your current Credit Status and assigned wholesale Tiered Pricing.

2. Pricing and Payment

• Pricing Accuracy: Prices listed on the Platform are estimated and are subject to change without notice until confirmed by an LHC Group Sales Representative.
• Payment Model: We operate on an "Order Now, Pay Later" basis.
• Accepted Methods: Payment methods include Cash on Delivery (COD), Direct Bank Transfer, or Invoice/Credit for approved B2B partners.
• Finalization: Digital payments are processed only upon confirmed finalization of the order.
• Invoicing: B2B partners are responsible for adhering to agreed-upon credit terms; LHC Group reserves the right to suspend ordering privileges for overdue accounts.

3. Delivery and Risk

• Timelines: Delivery timelines provided are estimates and may vary depending on stock availability and logistics.
• Transfer of Risk: Once the order has been dispatched or delivered to the agreed delivery location, the risk of loss or damage transfers to the customer unless otherwise agreed.

4. Account Responsibility and Use

• Registration: Users must provide accurate and complete information during registration.
• Security: You are responsible for maintaining the confidentiality of your account password, particularly for B2B partners accessing specialized pricing.
• Acceptable Use: Users agree not to misuse the Platform, including but not limited to attempting unauthorized access, scraping product data, disrupting system functionality, or using the Platform for fraudulent activities.
• Unauthorized Use: You agree to notify LHC Group immediately of any unauthorized use of your account.

5. Product Information and Warranty

• Product Display: While we strive for accuracy, product images and descriptions in the Catalog Hub may contain minor errors; confirmed details in the Confirmation Call supersede online listings.
• Warranties: Warranties for IT products are provided by the respective manufacturer and are handled as per local Sri Lankan consumer law and manufacturer terms.

6. Liability and Governing Law

• Limitation of Liability: To the fullest extent permitted by law, LHC Group shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform.
• Governing Law: These Terms are governed by the laws of Sri Lanka.
• Dispute Resolution: Any disputes arising under these Terms shall be resolved in the courts located in Kandy, Sri Lanka.
